Pakistan's Supreme Court upholds late former President Pervez Musharraf's death sentence in high treason case for declaring emergency in 2007. Justice calls for accountability for past wrongs.
Pakistan's Supreme Court has upheld the death sentence of the late former military ruler and former President Pervez Musharraf in a high treason case. The decision was handed down by a four-member bench headed by Chief Justice of Pakistan Qazi Faez Isa and comprising Mansoor Ali Shah, Justice Ameenuddin Khan and Justice Athar Minallah. The death sentence was initially given to Musharraf by a special court under Article 6 of the Constitution on December 17, 2019, during the tenure of the Pakistan Muslim League-Nawaz (PML-N). Musharraf had made the ‘unconstitutional’ decision to declare an emergency in November 2007, leading to the case of high treason being filed against him. The Supreme Court's decision comes after the Lahore High Court (LHC) declared the verdict given by the special court as “unconstitutional” on January 13, 2020. The Pakistan Bar Council and several senior lawyers, including Taufeeq Asif, challenged the Lahore High Court's verdict. However, the Supreme Court has now upheld the death sentence, stating that Pervez Musharraf's heirs did not follow the case even after multiple notices. During the hearing, the top court also emphasized the accountability of all those, including the judges, who validated the martial law imposed by Musharraf on October 12, 1999. Chief Justice of Pakistan Qazi Faez Isa highlighted the importance of learning from history and acknowledging past wrongs, stating that even if someone was not punished for abrogating the Constitution, it is important to admit that it was wrong. Pervez Musharraf, who died on February 5, 2023, had filed an appeal against the special court's verdict in 2019, but the appeal was ultimately rejected by the Supreme Court. The court declared the appeal ineffective for non-compliance and upheld the death sentence in the high treason case. This decision by the Supreme Court brings an end to the legal battle surrounding the high treason case against the former military ruler, underscoring the importance of upholding the constitutional principles of Pakistan.
