A lawsuit has been filed against the University of California (UC) system, UC Berkeley, and its administrators by two Jewish groups, alleging the unchecked spread of anti-Semitism. This lawsuit comes as one of the first to be filed against a major university following the Israel-Hamas war, and in the midst of an increasing number of colleges and school districts facing investigations related to incidents of anti-Semitism and Islamophobia. The Brandeis Center and Jewish Americans for Fairness in Education filed the lawsuit in federal court in San Francisco.

They claim that UC Berkeley has witnessed displays of hatred, harassment, and physical violence against Jews since the Oct. 7 Hamas attack on Israel. The groups are seeking court intervention to protect students and faculty, and to address what they perceive as anti-Semitic discrimination and harassment, which they argue violates the U.S. Constitution, federal civil rights laws, and university policy. According to the lawsuit, at least 23 student groups at UC Berkeley School of Law have implemented policies that discriminate against and exclude Jewish students, faculty, and scholars.

The organizations accuse school leaders of being aware of these anti-Semitic policies but failing to take any action to address them. However, UC Berkeley's law school dean, Erwin Chemerinsky, has disputed the claim, stating that the lawsuit provides an inaccurate picture of the Law School and neglects the First Amendment. Chemerinsky maintains that although the campus can create an inclusive learning environment, it cannot curtail offensive speech. In response, a spokesperson for UC Berkeley highlighted the university's commitment to confronting anti-Semitism and supporting the needs and interests of its Jewish community.

The university referred to various initiatives aimed at addressing anti-Semitism on campus and beyond. The Jewish groups also allege that UC Berkeley and its law school have not addressed the anti-Semitic environment fostered during student protests following the Oct. 7 attack. They cite instances of hate emails targeting Jewish individuals, calling for their gassing and murder, as well as an incident involving a Jewish student being attacked by protesters.

In response, the UC Berkeley spokesperson stated that the university has not received reports of such emails, emphasizing that the university takes such allegations seriously and would respond swiftly if any were brought to their attention. This lawsuit follows a similar case in which three Jewish students filed a lawsuit against New York University earlier this month, alleging anti-Semitic incidents on the campus. The lawsuit against UC Berkeley highlights the ongoing struggle universities face in combating discrimination and hate speech, and the legal battle over where the line should be drawn between freedom of speech and protecting students from harassment and discrimination.
