Imran Khans Fate Hangs in the Balance as Islamabad High Court Reserves Verdict on Toshakhana Case

The Islamabad High Court (IHC) has reserved its decision on former Prime Minister Imran Khan's plea against his sentence in the Toshakhana case. The verdict, originally expected today, will now be announced on Tuesday at 11am. Imran Khan, who is currently in Attock jail, has challenged the three-year prison term handed to him on August 5, 2023, by an Islamabad district court. The trial court's verdict effectively prevents Imran Khan from contesting the general elections for five years. Imran Khan's lawyer, Latif Khosa, and the Election Commission of Pakistan's (ECP) counsel Amjad Pervez appeared before the court.

During the hearing, the former prime minister appealed to the bench to issue an order on the plea seeking access to legal counsel in jail. The bench remarked that it hopes to issue the verdict on the plea for annulment of the sentence today. The ECP lawyer argued that notice to the public prosecutor is necessary before proceeding with the annulment of the verdict. He emphasized that the trial has to be held by a court regardless of whether the complaint was filed under a magistrate or directly. The court has reserved its verdict and adjourned the hearing.

Imran Khan's lead counsel argued that the complaint against him was not filed correctly at the proper forum and that the trial court did not allow him to present witnesses in his defense. He also highlighted the defects in the trial court's order and the court's disregard of the Islamabad High Court's instructions. The ECP counsel stated that the case is about the submission of a fake declaration of assets and liabilities, not tax evasion. The ECP had filed a complaint against Imran Khan for incorrect declaration of assets and liabilities on the ECP's form B. The court has postponed the announcement of the verdict to Tuesday.
